Indecent exposure is a sex crime in the state of Florida as stated in the 2011 Florida Statutes: TITLE XLVI, Chapter 800. This crime is listed under the category LEWDNESS: INDECENT EXPOSURE. The law forbids exposure of sexual organs in public, in the private premises of another person or in close enough proximity to be seen from private premises. The exposure must be vulgar, and indecent exposure includes public nudity anyplace other than a specified area set aside for nudity. A mother breastfeeding an infant is excluded from this law.
Suspect Age is a Factor
If this sex crime is committed in front of or in view of persons under age 16, there could also be charges of child sex abuse. An offender over age 18 could be charged with committing lewd or lascivious exhibition, which is a second degree felony; one under age 18 could be charged with a third degree felony. (800.04)(c, d)
Victim Age is a Factor
Indecent exposure in front of underage children can also be a crime of child abuse. Impressionable children may have lasting psychological problems if they witness indecent exposure.
Using an electronic method to commit indecent exposure is included as illegal under this statute if the suspect believes or knows the viewer is under age 16. If this occurs as part of an undercover law enforcement sting operation, that fact is not allowed to be included in defense efforts.
Penalties for Indecent Exposure:
- Mandatory prison time up to 15 years, as provided in s. 775.082, s. 775.083, or s. 775.084.
- Felony sex crime offense goes on your permanent criminal record.
- Requirement to register as sex offender or sexual predator for the rest of your life.
- Minimum punishment is sex offender probation.
- Possibility of lockup in a civil commitment facility when prison sentence is completed.
- Sex Offender Probation – restricts work and living areas, sets a curfew and requires counseling.
